Health and Safety Code 1569.39 allows RCFEs to accept and retain residents with Prohibited Health Conditions. The 2016 law requires facilities to assist these residents with accessing home health or hospice. DSS wants facilities admitting and retaining residents with prohibited health conditions but NOT on hospice, to seek an exception.
This product has DSS exception requests for facilities to accept G-Tubes; serious infections, including HIV; Stage III or IV wounds; bedridden; accepting a resident on hospice that exceeds current facility hospice waiver; and “total care,” or residents who depend on others for ADLs. We suggest the purchase of the newly updated physician’s report to supplement the exception requests as the new physician’s report contains a “service plan” authored by the physician and specifically addressing the health condition.
