Health and Safety Code 1569.39 allows RCFEs to accept and retain residents with Prohibited Health Conditions. The law requires facilities to assist these residents with accessing home health or hospice services. DSS wants facilities that do admit and retain residents with prohibited health conditions but NOT on hospice, to seek an exception to admit and retain these residents.

This product has exception requests to be submitted to DSS to accept G-Tubes; serious infections, including HIV; Stage III or IV wounds; accepting a resident on hospice that exceeds current facility hospice waiver; and “total care,” or residents who depend on others for ADLs. We suggest the purchase of the newly updated physician’s report to supplement the exception requests as the new physician’s report contains a “service plan” authored by the physician and specifically addressing the health condition.

As a bonus, this product includes a resident rate increase notice, and eviction notices for failure to pay and for residents with unmet needs.
